MouseCarts are warranted to the original purchaser to be free from defects in materials and workmanship for a period from date of purchase for 6 months.
Mouse L.L.C. will replace without charge the cart or those component parts that are determined by Mouse L.L.C. to be defective in manufacture under normal use and service during the applicable warranty period.
This warranty does not apply to any unit that has been abused or misused, altered by component parts substitution, or used for rental or other commercial uses.
Replacement of cart component parts determined to be defective shall be the remedy of any purchaser. Replacement parts must be handled through the retailer from whom the cart was purchased. lf upon examination it is determined that a replacement is justified, a replacement will be made without charge. Transportation costs and labor charges incurred in the replacement of parts are not covered by this warranty. Mouse L.L.C. reserves the right to make changes and improvements in the design and construction of its equipment without thereby being obligated to make corresponding changes and improvements in previously manufactured equipment.
All units and their components are covered as noted above.
Caution: The following exclusion applies to all MouseCarts. This warranty does not apply to any unit that has been used for stunt or trick riding, jumping, speeding, or other recreational uses. This type of operation is not the purpose or usage of this product. This product is intended for employee use only in a workplace setting. It is not intended for customer use, such as shopping carts in a retail setting. This product is intended to be used on flat level terrain with no inclines. Operator should not rely on brake for instant stopping. Speed should not exceed a brisk walking pace. Cart should be evenly loaded with weight of cargo not to exceed 100 lbs.
Mouse L.L.C. shall not be liable for incident or consequential damages.
Notices: The user assumes the risk of any personal injuries to self or bystander, damages to or failure of the cart and any other losses if MouseCarts are used in any manner. No motors or power-increasing component shall be added to cart. This warranty does not cover any personal injuries, damages to or failure due to improper maintenance. It is the responsibility of the operator to routinely check and make any minor adjustments such as tightening loose bolts, nuts, or screws; and check for worn or loose parts such as wheels and bearings.
The warranty set forth herein is the complete and entire warranty made by Mouse L.L.C., and there are no other warranties, express or implied, whether of merchantability, fitness for a particular purpose, or otherwise, made by Mouse L.L.C. No person is authorized to make any other or additional warranty on behalf of Mouse L.L.C. The right to repair or replacement, as set forth herein, is the sole and exclusive remedy for breach of the above warranty, and Mouse L.L.C. shall not be liable for any damages, whether direct, incidental, consequential or otherwise, occasioned by any breach of this warranty, or for any charges or expenses of any nature incurred without Mouse L.L.C.’s consent. even though Mouse L.L.C. has been negligent. ln no event shall Mouse L.L.C.’s liability under any claim exceed the purchase price of the equipment in respect of which damages are claimed.
